Terms and Conditions
All invoices are to be paid within 30 days, which are the default terms under UK law. Interest can be levied on late payments at prevailing rates and will be invoiced separately. Notices of which will be sent after any invoice is more than 30 days past due. Apptelic reserves the right to change its Net 30 terms (to Net 15 day terms) for any particular customer if payments have been consistently late. Apptelic also reserves the right to charge customers an upfront amount before any work commences.
Should Apptelic be used for development by an agency to work on projects for their customers / clients and Apptelic has past invoices outstanding from the agency Apptelic is within its right to make contact of agency’s customer(s) / client(s) to let them know we have not been paid. Agency’s customer then have the option to work directly with Apptelic.
Deliverables and Support
As Apptelic works on a work for hire basis all development is warranted until up and including the delivery date. Apptelic provides 30 days technical support to resolve any critical issues. Thereafter the customer / client can elect Annual Support which is a billable service. Whilst under Annual Support customers will have access to discounted development rates.
Apptelic provides 3rd Line Support in the 30 days included support, which does not include any end user support or any new development. The 30 days included support starts from the delivery date of the software / app. Subsequent deliveries or upgrades to the software / app with a development cost that exceeds £5K per month will be given a further 30 days included support.
If more than 60 days has lapsed from software / app delivery date Apptelic is under no obligation to provide annual support, even if an offer of annual support had been previously extended to a customer. Annual Support terms and conditions, and pricing are at the sole discretion of Apptelic.
Should a customer be late on any payments for whatever reason, Apptelic is within its right to withhold future deliverables of associated releases of software / app(s).
As work is on a work for hire basis all code is assigned to customer and Apptelic acknowledges it owns none of the intellectual property (“IP”) associated with the software / app. Any rights Apptelic does have with regards to the software / app IP are wholly assigned to the respective customer. Notwithstanding any of the above, the only right Apptelic retains is know how rights learned from the development so that it can gain other work and/or employment.
